This position, reporting to the EVP and General Counsel for Litigation, provides legal advice, guidance, and support to ensure that the company’s exposure to legal risk i! s managed.
The position will have line of sight into litigation across all
U.S.
operations.
Generally, this position will work with other in-house counsel within the litigation team to ensure that matters requiring focus and/or escalation are addressed, including adequate tracking of trends, interface with Compliance and Risk organizations, and analysis of root cause.
Will directly manage a docket of certain litigation.
In conjunction with relevant personnel, will advise on appropriate litigation reserves.
Will coordinate and communicate policies, procedures, and controls to ensure that the company’s exposure to legal risk in the assigned department is managed appropriately.

Provides counse! l on a variety of legal matters, or in a specialist area, including matters that may be complex or have potential for some materially impact

Be a trusted adviser to the business by ensuring that commercially sensitive, pragmatic and practical legal support and advice is provided in a cost-effective manner to assigned segment business line or function

Provide support and guidance to assigned area with regard to legal risks arising in jobholder’s area of expertise
·
Employ legal policies to ensure that the Group’s exposure to global legal risks is managed appropriately
Customers / Stakeholders
·
Provide prompt, commercial, practical and sometimes complex and or specialized legal advice to assigned segment business line or area
·
Be pro-active in the provision of legal support and in advising areas of supports promptly of material legal developments and their implica! tions
·
Ensure senior legal management is fully briefed on major issues arising in relevant business area and major legislative changes in area of expertise or speciality
·
Recommend selection of panel law firms and other appropriate external parties as required
Leadership & Teamwork
·
Maintain and develop positive and professional working relationships with all team members within Legal Team and business areas for which the jobholder is responsible
·
If the structure is such, lead, manage, review, guide and support junior lawyers and/or support staff that report to the jobholder
·
Participate in the coordination and promotion of initiatives that result in the sharing of legal knowledge and best practices across the Regional/Global Legal Function
Operational Effectiveness & Control
·
Provide legal services in a cost-effective manner.

Co-ordinate and manage the approach to legal risk in assigne! d business departments for which the jobholder is responsible, to ensure that the interests of the HSBC Group are adequately protected

Employ legal risk management policies and controls in relevant business areas
·
Assist the business to remain compliant with legal risk management requirements set out in the Group Standards Manual and Legal FIM
·
Awareness of the operational risk scenario associated with the role and to ensure that all actions during employment with HSBC take account of the likelihood of operational risk occurring
·
Leadership over all regulatory and compliance matters and the management of operational risk
·
Complete other responsibilities, as assigned

Management of Risk
·
Ensure compliance, operational risk controls in accordance with HSBC or regulatory standards and policies; and optimize relations with regulators by addressing any issues

Observation of Internal Controls
·
Maintains HSBC internal control standards, including timely implementation of internal and external audit points together with any issues raised by external regulators
Qualifications
·
Minimum of eight years proven and progressive corporate legal experience, or equivalent
·
Minimum of a Juris Doctorate degree as well as admission to applicable state Bar and pertinent levels of courts in applicable states
·
Strong advocacy, negotiation, interpersonal, organizational, legal research and verbal and ! written communication skills
·
Ability to quickly ap! ply abstract concepts of law and make quick, innovative decisions to resolve problems
·
Ability to defend the Company and Group affiliates from claims and advocate their interests while maintaining their reputation for honesty and integrity
·
Proficiency with personal computers as well as pertinent mainframe systems and software packages
